KARACHI: The Sindh High Court (SHC) directed customs officials to file their para wise comments on several constitution petitions filed by a citizens against detention of their imported vehicles due to alleged tax evasion.
On 28 September 2019, counsel for the petitioners argued that their counsels are law abiding and peace loving citizens and they imported vehicles of different brands for their own or family members, however, officials of the customs department seized their vehicles without showing any lawful reason and authority.
Counsels submitted that they approached Customs Appellate Tribunal for seeking release of their vehicles and same was allowed, however, officials of customs department are refusing to release the same.
Citing collector of Customs Collectorate Preventive and others as respondents, petitioners pleaded the court to declare that act of the respondents as illegal, malafide and arbitrary.
They also pleaded the court may direct them to release their vehicles immediately and prohibit/restrain the respondents and their officers from taking any coercive action against the petitioners in respect of the said vehicles and also restrain them to safe vehicles till disposal of their petition and grant such other relief or reliefs which this court may deem fit and proper under the circumstances of the case.
