KARACHI: The Sindh High Court (SHC) issued notices to the customs department and deputy attorney general on a petition filed by M/s Rehan Can (Pvt) Ltd against enhancement of valuation of imported ETP TIN Plate secondary quality from $0.595 kg to $0.765 kg under the garb of valuation ruling no 756/2015.
On 16 March 2020, a two-member bench, headed by Justice Aqeel Ahmed Abbasi also directed them to file their respective para wise comments on next date of hearing.
During the hearing, counsel for the petitioner stated that petitioner has imported a consignment comprising ETP TIN plate secondary quality on unit value of $0.595 kg and the department is forth fully going to assess value $0.765 kg on the basis of impugned valuation ruling no 756/2015.
He further submitted that petitioner has further approached with the director valuation vide their application along with other requesting them to allow provisional release of the consignment which has been denied by the customs officials.
He further said that in spite of the patent illegalities evident from the contents of the impugned valuation ruling itself, the respondent is proceeding to assess the above mentioned consignment by the petitioner and it is apprehended that the same shall be applied on shipped pipeline consignments imported by the petitioner, the petitioner’s consignment is at port and incurring heavy port demurrages besides other financial charges on containers.
Citing chairman FBR, collector of Customs Appraisement West/ East and Director of Valuation as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
He further pleaded the court may direct them to release its consignment and restrain them from taking any coercive action against the petitioner till final order in this case.
