KARACHI: The Sindh High Court (SHC) on Tuesday sought comments from the tax authorities on an application filed by Karachi Foods and others against the raid on restaurants by a team of Commissioner IR.
A division bench of the SHC comprising Justice Munib Akhter and Justice Abdul Malik Gaddi heard the petition of Karachi Foods, Murtaza Raza Ladhubhai and Hussnain Raza Ladhubhai. During the hearing, the counsel for the respondents requested some time for filing para wise comments.
Earlier, the petitioner’s counsel stated that on April 5, 2016 some persons who claimed to be the officials of the Commissioner IR, Zone – IV, RTO and Chief Commissioner IR came along with two police mobiles and raided the restaurant premises of the Karachi Foods situated at Do Darya, Beach Avenue, DHA and the head office of Karachi Foods situated at 610 Panorama Centre, Saddar Town. The raiders took away laptops, computers, box files etc.
The counsel argued that each and every transaction of the Karachi Foods business is duly recorded in the cash register for which complete record is available and it has been paying all the due taxes.
The counsel prayed the court to declare the act of the respondents as illegal and mala fide. The court was further requested by the petitioners to restrain the respondents from taking any action against them.
