KARACHI: The Sindh High Court (SHC) has directed the Income Tax Department to file para-wise comments on a petition filed by M/s Perviaz Sons against increased valuation of $1.90 per kilogramme instead of $1.30/kg of its consignment of “synthetic rubber acrylonitrile butadiene rubber”.
A two-member bench, headed by Justice Irfan Sadat Khan was hearing the petition. During the hearing, counsel for the tax department sought time for submitting para-wise comments.
Earlier, counsel for the petitioner stated that petitioner entered into a contract and imported consignment of synthetic rubber acrylonitrile butadiene rubber, which was shipped on December 12, 2015 and reached Karachi port on January 28, 2016.
According to the petitioner, it filed goods declaration as valuing $1.30/kg, however which was assessed by officials of the Customs Valuation on the basis of amended Valuation Ruling 772/2015 dated April 23, 2015, but the same was being enhanced to $1.90/kg, which was challenged by several parties before authorities concerned.
The counsel argued that petitioner goods and consignment is lying on the port area and suffering from heavy demurrage.
Citing Federal Board of Revenue (FBR) chairman, Customs Valuation director general and collector of Appraisement-East as respondents, the petitioner pleaded the SHC may direct the respondents to release the consignment on its declared valuation.
