KARACHI: A division bench of the Sindh High Court (SHC) dismissed application for urgent hearing filed by M/s Burshane Petroleum Pvt Ltd for changing its name from M/s Burshane Petroleum (Pvt) Ltd to M/s Darian International (Pvt) Ltd.
On 25 August 2020, a two-member bench, headed by Justice Muhammad Ali Mazhar heard the constitutional petition.
During the hearing, counsel for the petitioner stated that petitioner sent a letter on June 18, 2016 to the estate manager Karachi Port Trust (KPT) requesting to change the name of the company from M/s Burshane Petroleum (Pvt) Ltd to M/s Darian International (Pvt) Ltd.
He further submitted that however, respondent had issued a letter on February 01, 2019 stating therein that the request for change of name cannot be considered at this stage due to the matter subjudice in the court, petitioner argued that there is no case pending subjudice of the petitioner in the court of law against the respondents but petition filed by the petitioner while the port security port staff interfered in the smooth business functions of the petitioner and that has nothing to do with the change of the name of the petitioner.
He stated that petitioner as per the parameters of the same vicinity whereupon the other oil companies have been allowed to lay down having connectivity with all pairs and D.Ps from their terminals to the jetties and the case of the petitioner is at per as the petitioner cannot be discriminated such facilities which have already been provided by the respondents to other oil terminals in the same vicinity.
Citing secretary port and shipping, chairman Board of Trustees of the Port of Karachi and Estate Manager KPT as respondents, petitioner pleaded the court to direct the respondents that the name of the petitioner may be change and other formalities in this regard may be fulfilled.
He further pleaded the court to direct the respondents to allow the petitioner for repair and maintenance, replacement of the pipelines pertaining to the operation of the petitioner.
