KARACHI: The Sindh High Court (SHC) on Monday directed the customs authorities to release the consignment of “natural raw rubber sheets ” subject to the payment of entire differential amount by the petitioner in the shape of pay-order on a constitutional petition filed by M/s Ever Shine Business, seeking release order of its consignment.
During the hearing of the petition, a two-member bench, comprising Justice Muhammad Iqbal Kalhoro and Justice Khadim Hussain M Sheikh observed that ” if the petitioner prefers a reversion application against the valuation ruling, the same may be decided within 30 days whereof.
Earlier, the counsel for the petitioner stated that on 15/01/2016, the petitioner entered into sale contract with M/s Bothers (Private) Limited for import of natural raw rubber sheets RSS @ $1,350.00 matric ton. The exporter shipped 40 matric ton as per invoice dated 15/06/2016.
According to the petitioner, the respondents were required to revisit and assess fresh valuation after a lapse of every 90 days which exercise was not carried out by the respondents as such , on expiry of the 90 days, valuation no 787/2016 dated 1/1/2016 stood lapsed on 1/4 /2016. He argued that the imported product was being assessed at the flat rate of earlier expired valuation i.e $1350 through due to continue fall and decrease in international demand. Petitioner filed goods declaration dated 25/07/2016 @ fair transaction value of $1135, the same is being enhanced to $1350 and denied the benefit of Section 8 of the Customs Act, 1969.
Citing Secretary Revenue division, DG Director General of Valuation, Chief Collector Appraisment and others as respondents, Petitioner pleaded the SHC may direct the respondents to finalize the valuation ruling within 30 days.
