KARACHI: The Sindh High Court (SHC) on Friday issued notices to chairman National Accountability Court, federal minister for Law, Sindh government and chairman Anti-Corruption for July 3 on a petition challenging the NAB ordinance.
While keeping themselves safe from the NAB, the Sindh’s bureaucrats had approached the Sindh High Court, challenging the NAB ordinance and arrests of the government officers on almost regular basis.
The two-member bench headed by Justice Sadiq Hussain Bhatti issued notices on a constitutional petition by the Commissioner Shaheed Benazirabad, Ghulam Mustafa Phull.
The commissioner impleaded the chairmen of NAB and Anti-Corruption, federal minister for Law and Justice, Sindh.
The counsel, Barrister Zamir Ghumro, opined that the federally administered court had been established under Clause 55 of the Article 142 of the Constitution of Pakistan for a particular subject and the same do not have power to probe provincial officials.
The former dictator, Pervez Musharraf, had introduced the NAB Law under the PCO in 1999 which is illegal and in the violation of the Constitution, he added.
After 18th Constitutional Amendment, the corruption in provincial department is not the federal domain and the provinces have the authority to investigation the matter if so.
After hearing the arguments, the SHC issued notices to the above mentioned institutions to come up with their replies.
