KARACHI: The Sindh High Court ( SHC ) has fixed May 27, 2016 as a date of hearing of a petition filed by M/S Abbasi Trading Company against assessment of a consignment of PVC hollow wall panel at the rate of $1.20 per kilogram instead of $.0.90 per kg by customs authorities.
The SHC division bench, headed by Chief Justice Sajjad Ali Shah, heard the petition.
During the hearing, the counsel for the petitioner stated that petitioner imported a consignment of PVC hollow wall panel from China on July 7, 2015 at the rate of $0.90 per kg. However, the respondents had claimed to assess it at the rate of $1.20 per kg.
The counsel for the respondents argued that the petitioner had imported consignments in August, September and October, 2015; therefore, the officials were able to assess the goods on the basis of new valuation ruling at the $1.20 per kg.
The petitioner’s counsel requested for some time to show that even till date the rate under the same was being assessed at the rate of $0.90 per kg. On the request of petitioner’s counsel, the court adjourned the hearing for May 27, 2015.
Earlier, citing Ministry of Finance secretary, FBR chairman, Directorate of Customs Valuation, Appraisement-East as respondents, the petitioner pleaded the SHC to set aside impugned demand notice of mis-declaration.
