KARACHI: The M/s Master Sanitary Fitting Industries Limited has approached The Sindh High Court (SHC) and filed a constitutional petition against issuing letter for auction of petitioner’s imported goods.
On 6 January, 2020, counsel for the petitioner stated that petitioner’s company is a limited company and engaged in the business of sanitary fitting etc, for almost four decades now, Master remains the most trusted name in a diverse range of high-end sanitary fitting solutions.
He submitted that due to economic conditions of the country and financial crisis faced by the petitioner’s company and accordingly negotiation with the bank and supplier in respect of retirement of commercial documents, into bond goods declaration hearing machine no KAPE-IB-57386-21-10-2019 in respect of bill lading no A8019070210 was filed by the petitioner company.
He argued that goods were assessed and said goods declaration was gated out by the concerned customs authorities, however, due to some procedural requirements the concerned customs authorities are reluctant to put the goods in bond despite the fact and several requests were made by the petitioner in this regard.
Counsel said that since the customs authorities are reluctant to put the goods in bond, into bond goods declaration in respect of bill of lading could not be filed by the petitioner’s company, despite the fact that several request were made to the concerned customs authorities and hardships faced by the petitioner’s company, the customs authorities did not consider the requests and hardships faced by the petitioner and arbitrary and illegally refused to shift the imported goods bond.
Petitioner informed the court that now petitioner came to know that customs officials issued letters for auction of goods belong to the petitioner without fulfilling of legal requirement.
Citing collector of Customs Appraisement East, West, assistant collector (SAPT Auction Appraisement East, chairman FBR and others as respondents, petitioner pleaded the court may suspend the operation of impugned auction letters issued by the customs officials and direct them to shift the imported goods in customs bond forthwith till the final decision of this case.
