KARACHI: M/s International Food Stuffs Co and M/s IFFCO Pakistan Private Limited has approached the Sindh High Court (SHC) and filed a petition against using its similar trade mark by M/s Sardar Muhammad Beautifying Cosmetics Pvt Ltd.
On 6 October, 2020 counsel for the petitioner stated that petitioners are the manufacturer and merchant of soap brands, which are developed with a sound understanding of consumer preferences of leather, feel, fragrance and cosmetic appeal in the middle east, Arian, CIS selected Asian courtiers including Pakistan.
He further submitted that petitioner not only got its trademark ‘SAVANNAH’ registered in Pakistan, on the top of that, it has secure its intellectual property rights associated with trade mark under trade mark ordinance, 2001, and products by registering artistic work/ label design under the title ‘SAVANAH’ under the copyright ordinance 1962.
He further submitted that however, M/s Sardar Muhammad Beautifying Cosmetics Pvt Ltd wrongly, falsely, dishonestly and fallaciously claims to be the owner/ artistic of the artistic work, ‘SUHANA BEAUTY SOAP’ as a matter of fact, the petitioners has been continuously and extensively marketing the goods baring ‘SAVANNAH’ and is the first every creator and user of the subject work.
He argued that petitioners for rectification possess exclusive rights over user of the said copyright work and any respondent’s claim contrary to what is stated herein is expressly denied.
Citing chairman Intellectual Property Organization of Pakistan, Registrar of Copyright and Sardar Muhammad Beautifying Cosmetics Pvt Ltd as respondents, petitioners pleaded the court to declare that grant of all or a, copyright registration including copyright registration no 26984-Copr to respondent by Registrar of Copyright in respect of artistic work under SUHANA BEAUTY SOAP in the absence of trademark registration is without lawful authority and of no legal effect.
