KARACHI: A division bench of the Sindh High Court (SHC) directed customs department to file comments on a constitutional petition filed by M/s Al Amin Traders seeking release order for its imported consignment of Chana Straw (Animal Feed) and tobacco stream and powder (Snuff Powder).
On 27 January 2021, during the hearing, counsel for the petitioner stated that petitioner is an exporter of Chana Straw (Animal Feed) and tobacco stream and powder (Snuff Powder) and engaged in export of consignment and for the purpose of this petition the petitioner has filed goods declaration for export which was marked for examination which was accordingly examined and reported that good stuff in the container are tobacco steam and powder.
He further argued that however, a show cause notice on the basis of the above examination report was issued to the petitioner which was defended that thereafter an order-in-original no 1586186 dated Oct 01, 2020 was issued by the learned additional collector of customs adjudication.
He further stated that the petitioner has approached to the collector of customs exports to implement the order-in-original but instead of comply orders of adjudication authority the respondents have filed an appeal before customs appellate tribunal wherein they have not alleged any duty or taxes or any restrictions of the export of both type of consignments.
Citing chairman FBR and collector of Customs Export as respondents, petitioner pleaded the court may direct them to implement the order-in-original passed by adjudicating authority and further direct to allow dray off the impugned consignment.
He further pleaded the court to restrain them from taking any adverse action against the petitioner or their officers till final order in this case and grant any other relief deemed fit in in the circumstances of the case and grant order as to costs.
