KARACHI: Jubilee Life Insurance Company Limited has moved the Sindh High Court (SHC), challenging a recovery notice of Rs 100 million issued by the additional commissioner Inland Revenue Audit Range B, Zone-III Large Taxpayer Unit.
The petitioner also sought the court directions for disposal of its appeal pending before the commissioner Inland Revenue Appeals-I, Audit Range B, Large Taxpayer Unit.
In his constitutional petition, counsel for the petitioner stated that petitioner is engaged in life insurance business and is fulfilling all liabilities regularly. However, the additional commissioner Inland Revenue Audit Range B, Zone-III Large Taxpayer Unit issued a show cause notice to the petitioner, alleging that the petitioner’s assessment for tax year 2014 was erroneous insofar as it was prejudicial to the interest of the revenue.
He argued that the petitioner had filed comments in details and explained its position. However, the additional commissioner demanded Rs 100 million. Being aggrieved it approached the commissioner Inland Revenue Appeals-I and filed an appeal along with a stay application. He said that the application is still pending before the same which has failed to decide the appeal within reasonable period. He said that in the absence of the stay order, the petitioner has apprehension of coercive action from the respondents.
Citing Secretary Revenue Division, the commissioner Inland Revenue Appeals-I, Audit Range B, Large Taxpayer Unit and additional commissioner Inland Revenue Audit Range B, Zone-III Large Taxpayer Unit as respondents, the petitioner pleaded the court may direct the commissioner Inland Revenue Appeals-I to decide appeal of the petitioner within reasonable period and till final decision of its appeal, court may restrain them from taking any coercive measures against it.
