KARACHI: The Customs Court issued notices to special prosecutor for customs department on an application for acquittal filed by Anjum Hafeez, Proprietor of M/s S. A Enterprises.
On 28 February 2020, during the hearing, counsel for the accused stated that there is absolutely no evidence with the prosecution which could connect the applicant with the alleged crime, trail of applicant would be futile as there is no possibility of conviction of the applicant even if entire prosecution evidence is brought on record.
According to the first information report (FIR) lodged by Appraisement West that received a credible information that betel nuts have been imported in the garb of ball bearings and toiletries and shipment is made from Dubai and container contained two LCL consignments imported by M/s Safwan Trading Corp and M/s S. A Enterprises and was to be cleared from Pak Shaheen Off-Dock Terminal.
As per FIR, the consignment was kept under surveillance but since no goods declaration was filed nor was the container moved to Pak Shaheen Off-Dock Terminal till April 17, 2018. The consignment was examined by AIF Staff which resulted in recovery of 13,150 kilograms betel nuts and 7 LED TV sets, the consignment was seized and on April 17, 2018 FIR has been lodged against suspects.
