KARACHI: The Customs Court issued notices to the customs officials and directed them to file their comments on an application under section 265K for acquittal by suspect Abdul Wahab S/o Abdullah, who was nominated in a case of attempting to smuggle high speed diesel.
On 25 April 2020, counsel for the applicant/accused moved application for acquittal and argued that prosecution claims that on an actionable information, an oil tanker bearing registration number TTA 858 was stopped, when the driver of the said oil tanker was asked about the loaded goods, he (driver) disclosed that 15,000 liters HSD was available in the oil tanker. When he was asked about the lawful documents regarding HSD, he could not present any documents. Further he stated that the owner of HSD Abdul Wahab Kashmiri directed him that after reaching at Hyderabad he should contact with him on cell phone for delivering the said HSD to its final destination.
Counsel argued that accused never indulged in illegal activities and he is not a hardened criminal and was not previously convicted.
Senior counsel pleaded the court that court may acquit the above mentioned suspect from the charges. After the hearing, court issued notices to the customs officials and directed them to file their comments on next date of hearing.
