KARACHI: Custom Court judge Faiz Rasool Rashdi granted bail to suspects, Samad Khan and Allah Noor Suleman Khail, in a case of attempting to smuggle 5,000 liters Iranian origin high speed diesel.
During the hearing, counsel for the suspects filed bail applications, stating that the applicants were innocent and were falsely implicated in this case, therefore, the court may grant them pre-arrest bail.
However, the counsel for the department submitted that the prosecution has sufficient evidence against the accused persons and they were not entitled to get bail, therefore the court may reject their bail applications.
After arguments from the both sides , the court granted bail to the accused persons against the surety bonds of Rs 100.000 each.
Earlier, investigation officer had produced the accused persons namely Samad Khan son of Azad Khan and Allah Noor Suleman Khail son of Bass Khan Suleman Khail before the court and submitted that both accused persons were trying to smuggle 5000 litters of Iranian diesel. After physical remand, court had sent them to Central Jail Karachi.
According to the FIR, on August 14, 2016 at about 2230 hours, Bedford track bearing registration number E-9315 tempered model 1979 traveling from Gadani to Karachi intercepted by Pakistan Coast Guards, driver of the Bedford truck who were later identified as Samad Khan and owner of the truck Allah Noor Suleman Khail were asked to check the track and during examination, officials of the Pakistan Coast Guards found 5,000 liters of Iranian diesel.
Case was registered by complainant Fazal Ahmed of Pakistan Coast Guards Korangi, Karachi due to violation of section 2 (s) and 161 punishable under Section 156 (1) (1) (8) and (89) of the Customs Act, 1969.
