KARACHI: The Customs Court has granted bail to suspect namely Ibadatullah son of Muhammad Usman against the surety of Rs. 100,000, who was booked in a case of smuggling of contraband goods.
On 20 December 2019, during the hearing, counsel for the applicant/ accused moved bail application and argued that prosecution claimed that in the instant case the present applicant/ accused in the driver of vehicle Hino Trawlar bearing registration number TLR-277 which was loaded with fifty one bails containing second hand clothing in addition to bonded transit, cargo, however the same is not permissible under afghan transit trade.
He further argued that applicant has been falsely implicated in this case and ready to face trail, therefore, court may grant his bail, however, counsel for the customs department argued that prosecution has strong evidence against him therefore, court may dismiss his bail application.
After the hearing, court observed in its order that case is punishable upto five years imprisonment and as such does not all without the prohibitory clause of section 497 Cr. P.C, the interim charge sheet has been submitted and the evidential material has been collected against the present applicant, accordingly bail is granted to him subject to furnishing his solvent surety in the sum of Rs. 100,000.
According to the prosecution, case was registered against him for violation of under section 156(1) (8) (129) (64) of the customs act, 1969.
