Customs Court approves bail of suspects in tax evasion case

KARACHI: The Customs Court granted post arrest bail to suspects namely Abdul Rehman son of Muhammad Ashraf, Asif Khan S/o Abdul Ghafoor and Samiullah son of Muhammad Khalid, who were booked in a tax fraud case.
On December 27, 2019, counsel for the accused moved bail applications and argued that their clients are innocent and have falsely been implicated in this case, who are ready to face trail, therefore, court may grant their bail.
After the hearing, court ordered that “according to the prosecution’s own case the present applicants are the representative/ partner of M/s Asim Trader respectively and not the importer, however, the role of present applicants will better be determined during the trail in this offence, section 32A of the customs act, 1969 though is punishable upto 10 years but the lessor punishment provided is 5 years or alternatively it is punishable with a fine or with both.
Hence offence does not fall within the prohibitory clause of section 497 Cr.P.C the evaded amount of taxes is about Rs 4,00,000, the callan has been submitted and the evidential material has been collected against the present applicants/ accused by the investigation officer.
The custody of the accused is no more required by the prosecution, therefore, their bail applicant is allowed subject to furnishing their solvent surety in the sum of Rs 100,000 each with PR bond in the like amount to the satisfaction of this court”.
