LAHORE: Customs Appellate Tribunal has concluded the hearing of case of paper import and reduced the penalty .
The appeal was filed by the M/s Zahid Packages Private Limited against Additional Collector Customs, Faisalabad and others.
Muhammad Shabbir Gujjar, member judicial bench-I heard and examined the record produced by the parties and passed a judgment that the order passed by the additional collector Customs, Faisalabad was very harsh, the importer already pay the duties and taxes the fine also reduced from Rs 25,000 to Rs1,2500.
As per details of case, M/s Zahid Packages Private Limited was imported kraft paper and fluting paper and customs department found that importer use wrong DTRE, during the scrutiny department charged Rs 118484 in customs duty, Rs120854 under the head of sales tax and Rs 41588 in income tax.
After show cause notice, adjudication proceeding were culminated and Order-in-Original was passed the importer should pay short pay duties and also charged penalty Rs 25000.
Being aggrieved with the order in original, appellant filed the appeal before the Customs Appellate Tribunal on the grounds that impugned order by additional collector of Customs as illegal, order passed in mechanical fashion and without consideration of facts and also liable to set aside. On the other side, respondent denied all allegations and appeal for rejection of case.
After hearing arguments from both sides, Customs Appellate Tribunal has decided the case with remarks that redemption fine is reduced and case is decided and also informed the parties about the same case.
