The advisory read as “As a result of the coronavirus outbreak , we expect many ports to become congested in the coming weeks with a lack of reefer plugs and space yard capacity.
If and where this situation materialize, MSC will not be in a position to discharge your containers at the designated port and will have to rely on clause 19 (matters adversely affecting carrier’s performance ) of its Bill of Lading/sea waybill terms and conditions.
In substance, this means that your container(s) may be discharged at an intermediate or alternative port and held there until it is possible to forward them to the designated port of discharge. Shall the situation remain unchanged it may become necessary and MSC reserves its right to abandon the voyage and advise you from where your container(s) may be collected. Kindly note that in both cases, the Merchant will have to pay for any additional freight and costs generated.
